Deskathon Terms of Use

Effective date: 1 November 2026

These terms are between you and VPO Labs ([legal entity — owner to confirm]), the maker of Deskathon. Please read them with the Privacy Policy.

1. Apple's Standard EULA applies

You get Deskathon from the Mac App Store. The Apple Standard End User License Agreement (Standard EULA) governs your use of the app:

https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

We do not replace it with a custom license. The short additions below explain things that are specific to Deskathon. If an addition conflicts with the Standard EULA, the Standard EULA wins.

2. What Deskathon is

Deskathon is a menu bar app that counts pointer distance, clicks and scroll per hour, and (only if you turn it on) key presses. It shows these numbers as charts, landmarks and share cards. It is made for curiosity and fun.

3. Not medical or ergonomic advice

Deskathon is not a medical device. It gives no health, fitness, posture, ergonomic, calorie or productivity advice. Its numbers and comparisons do not diagnose, treat or prevent anything. If you have pain, strain or a health concern, talk to a qualified health professional.

4. Numbers are estimates

  • Distances are approximations. Deskathon converts pixels to real distance using the screen size your Mac reports, or a size you set. If macOS reports the wrong size, or you use mirrored, rotated or unusual displays, results will be off. You can correct the screen size in Settings › Displays.
  • Counts can be incomplete. Deskathon may miss or double-count input, for example while your Mac sleeps, while the app is paused or closed, when macOS hides keys (password fields and other secure input), or if you withdraw the Input Monitoring permission.
  • Comparisons are for fun. Landmark and trip comparisons (for example "1.5× Burj Khalifa" or "London → Paris") use rounded public figures and are not exact. Landmark and place names are used only to describe distances. We are not affiliated with, and not endorsed by, any landmark, place or owner.
  • Do not rely on Deskathon for billing, time tracking, legal evidence, compliance or any decision where accuracy matters.

5. Use it on your own Mac

Only turn on keyboard counting on a Mac you own or are allowed to manage, and only to count your own use. Do not use Deskathon to secretly monitor another person. You are responsible for following the laws and workplace rules that apply to you.

6. Deskathon Pro

  • Deskathon is free. Deskathon Pro is an optional, one-time purchase (not a subscription). It unlocks longer history, more widget sizes, more share cards and other extras. The price for your country is shown in the app before you buy. Free and Pro both count and store all of your data.
  • Apple handles the purchase. Payment, taxes, receipts, billing problems, refunds and Ask to Buy are handled by Apple under Apple's terms. Ask for a refund through Apple (https://reportaproblem.apple.com). We cannot refund or cancel an App Store purchase.
  • Restore. If you reinstall or change Macs, use "Restore Purchases" in Settings › Pro with the same Apple Account.
  • Family Sharing. Pro supports Family Sharing. Members of your Apple Family Sharing group may use Pro under the rules Apple sets. If you or a family member lose access (for example after a refund, or on leaving the group), Pro is removed on that Mac. Your data is never deleted. It is only hidden again behind Pro.
  • Pro does not depend on keyboard counting, and you do not need to grant any permission to buy or use it.
  • We may change the price or the free/Pro split in future versions. A change does not take away a Pro purchase you already made.

7. Your data

Your statistics are yours. They stay on your Mac. We claim no rights over them. The Privacy Policy explains what the optional VPO Core features send and how to delete it. "Erase All Data…" in Settings › Privacy & Data deletes your statistics permanently, and we cannot restore them.

8. Share cards

You choose what to share and where to send it. You are responsible for what you post. Deskathon's name, icon and design remain ours (see Copyright and trademarks). Sharing a card that carries Deskathon's name, for ordinary personal and editorial purposes, is fine.

9. Support

Support is by e-mail at support@vpolabs.com, or through Feedback in the sidebar of the main window. We reply as soon as we reasonably can, with no guaranteed response time. Please include your Deskathon version, your macOS version and what happened. We support the macOS versions listed on the App Store page.

10. Updates and changes

We may update Deskathon to fix bugs, support new macOS versions or improve it. Updates come through the Mac App Store. We may change or stop features, within the law. We will not remove a Pro feature you paid for without a good reason, such as a legal requirement, security, or a macOS change that makes it impossible.

11. No warranty, limit of liability

Deskathon is provided "as is" and "as available", as set out in the Apple Standard EULA. To the extent the law allows, VPO Labs is not liable for lost data, lost profits, or indirect or consequential harm from using Deskathon. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, and your mandatory consumer rights. As the Standard EULA explains, Apple is not responsible for maintenance and support of Deskathon. Questions about the app go to us.

12. Governing law

[Owner to confirm.] These terms are governed by the laws of Romania and applicable European Union law, without regard to conflict-of-law rules. The courts of Romania have jurisdiction, except that if you are a consumer, you keep the protection of the mandatory laws of the country where you live and the right to go to the courts there. EU consumers may also use the European Commission's online dispute resolution platform. The Apple Standard EULA has its own governing-law clause for the license itself.

13. Changes to these terms

We may change these terms when Deskathon or the law changes. The effective date above shows the current version. If you keep using the app after a change, you accept the new terms, unless the law requires something more.
